Terms and Conditions of Use for Terme di Comano Digital Gift Cards
1. Subject
1.1 The gift card ("Gift Card") is a digital voucher that allows its holder ("Customer") to pay for purchases, in whole or in part (and therefore integrating the payment if necessary) within the online shop of Azienda Consorziale Terme di Comano ("Seller"), available at the following link: www.termecomanoskincare.it.
1.2 The Customer and the Seller agree that the use of the Gift Card will be governed by these Terms and Conditions of Use and, for anything not expressly provided for, by the general terms and conditions of sale published in the online shop.
2. Recipients
2.1 The Gift Card is assigned by the Seller to the Customer or to the person to whom the latter wishes to assign it, upon payment of its equivalent economic value.
2.2 The Customer declares to qualify as a "consumer" and to act for personal and private purposes of direct enjoyment of the Gift Card and the products offered by the Seller.
2.3 The Customer also undertakes not to resell or transfer the Gift Card to third parties, except as provided for by the procedures established by the Seller.
3. Purchase methods
3.1 The Gift Card can only be purchased within the online shop, with the payment methods provided and available, excluding the "cash on delivery" method due to its exclusively digital issuance.
3.2 In this regard, it is specified that, after purchase, the Gift Card is sent by e-mail to the address provided by the Customer.
3.3 The e-mail containing the Gift Card will be considered received by the recipient after sending it to the address indicated by the Customer: in case of non-receipt after 3.4 (twenty-four) hours from the purchase, the Customer must contact Azienda Consorziale Terme di Comano to verify what happened.
3.5 Azienda Consorziale Terme di Comano will not be held responsible in any way for the non-receipt of the e-mail containing the code, for delay or non-use of the same and/or for causes of force majeure or in any case not attributable to Azienda Consorziale Terme di Comano, including the application of spam filters by its e-mail provider to the e-mail containing the code.
4. Amount and validity
4.1 The Gift Card has a predetermined amount, which can be selected by the Customer in the following values: euro 30 (thirty), euro 50 (fifty), euro 100 (one hundred), euro 150 (one hundred and fifty).
4.2 The purchase of the Gift Card is not subject to VAT, pursuant to the combined provisions of articles 2, paragraph 3 letter a) and 6-bis, 6-ter and 6-quater of Presidential Decree 633/1972 and subsequent additions and amendments.
4.3 The Gift Card is immediately active.
4.4 The validity period of a Gift Card is 12 (twelve) months from the purchase.
4.5 Upon expiry of the validity period, the Gift Card that has not been used, or has been only partially used, cannot be refunded, replaced or reactivated.
4.6 In no case can the Gift Card, even if partially used, be converted into cash, nor does it produce interest of any kind.
5. How to use
5.1. The Customer interested in purchasing a product, within the online shop, through a Gift Card, must proceed to select and confirm their order, then - before confirming - enter the Gift Card code in their possession, in the appropriate field.
5.2. If the purchase price of the desired items is lower than the value of the Gift Card or its remaining value, the remaining credit will consist of the difference between the available value before the purchase and the amount used for that purchase.
5.3. If the purchase price of the desired items is higher than the value of the Gift Card or its remaining value, the difference must be paid by the Customer using the other payment methods made available on the online shop.
5.4. Even in this case, it will not be possible to use the cash on delivery method.
6. Return of purchased products
6.1. In case of total or partial return of the order placed using a Gift Card, the Customer will be reimbursed totally or partially through the re-credit of the sums to the same payment methods, including the Gift Card, actually used during the purchase phase.
7. Theft, damage or loss
7.1. The Gift Card is issued to the bearer.
7.2. For this reason, if it is improperly used, lost, stolen and/or damaged, it cannot be blocked, replaced or refunded.
7.3. No responsibility can be attributed to the Seller for any improper and/or fraudulent use of the Gift Card by its holder.
8. Reports and complaints
8.1. Any report or complaint relating to the use of the Gift Card can be sent to Customer Service through the contact tools made available by the Company on the website termecomanoskincare.it
